New found Dead Sea Scrolls

Well, it’s not new, but additional Dead Sea scrolls have been located in a previously unexplored cave. Archaeologists have discovered (even before recorded history) when people lived in caves, that they had an area in their dwelling dedicated to food preparation. Traditionally known as “The Kitchen”, the name lived on and over the millennium this specialized subdivision of the home has developed from a simple stone work surface to the exciting kitchens of today. And, one of the most exciting parts of a novelty for this room is the countertop.

The countertop and its upright counterpart, the backsplash, can add distinctive style to your kitchen, but choosing a surface material isn’t as easy as it was a thousand years ago. There are so many types of countertops available today that it can be very confusing when you decide to buy a new one.

While certainly a factor, your kitchen work surface shouldn’t be chosen solely for its aesthetic value. When you’re ready for a new counter, find a contractor who will take the time to review your specific needs. What kind of food do you prepare? How much do you cook? Have children? The answers to these questions will help determine the appropriate counterpart material for you.

Referred to by many as “Formica,” laminate countertops are the most affordable of all options, and with proper care, they can last a long time. Easy to clean with good stain resistance, it has limitations: it scratches easily, cannot be cut, and will burn if you place something hot on the surface. Once damaged, it is difficult or impossible to repair it.

The most popular countertops today are those made of stone, which, by the way, is just what archaeologists found in kitchens of yesteryear. The most demanded stone materials are granite, marble and the new crushed quartz countertops. Granite, the traditional resource, is considered by many to be the most beautiful surface available because it shows movement. The newer offerings in countertops are green, which is great for the environment; however, as with most “green” products, they are often more expensive than their traditional counterparts.

As with all home improvement decisions, don’t be too rushed into choosing your countertop. Investigate all the possibilities with your advisor and select a surface that is not only pleasing to the eye, but also suits your needs. And maybe it will last until your place is dug up a thousand years from now!

Venturi Fetish Sports Car Review

Venturi or Automobiles Venturi achieved iconic status as a leading manufacturer of sports cars. At the height of his involvement in auto racing, he went head-to-head with the Italian Ferrari, the French Bugatti and the German Porsche. These industry giants dominated the racing circuit in Europe. In fact, on countless occasions the Venturi has shown superiority over its renowned rivals. But in 2001, Monegasque millionaire Gildo Pallanca Pastor bought the rights to the French Automobile Company and soon shifted focus to the production of eco-friendly, eco-friendly cars.

To promote the viability of an electric car as a primary mode of transportation, the Venturi Fetish has embarked on a 2-year world journey. Unfortunately, this type of advice is still promoted and fails to take into account the one critical factor that builds muscle size. And that factor is “Rest”.

California Guardianships

Background

Definition. A guardianship is used in California when a person is unable to handle their own financial affairs or take care of themselves physically, so the court appoints someone else to handle these matters.

Since 1981, guardianship in California can only be obtained for a person under the age of 18. However, other states use the term “guardianship” for what California now calls a conservatorship.

Terminology. A guardianship must be established by a court. The person who needs the help is called a “guardian” and the person who is given the authority to handle the financial, medical, and/or other affairs of the person who needs the help is the “guardian.”

Types of Conservatories. There are two basic types of guardianships, a guardianship of the person and a guardianship of the estate. Often a conservator fills both roles, but it doesn’t have to be that way.

Curator of the Person. A guardian of the person ensures that the ward has adequate food, clothing, housing, medical care, social contact, and sources of enjoyment.

estate curator. A conservator of the estate manages the ward’s finances.

A conservator of the estate must use the ward’s money and other assets to support (and educate, if applicable) the ward and any dependents.

If the proper court order is obtained, the guardian can handle not only the ward’s personal finances, but also his business affairs.

The process

Start of the process. A guardianship is initiated by filing documents with the Probate Court and serving copies on the proposed ward and his or her next of kin.

Obviously, this can be a painful process for the conservatee, who is required to give up their rights to manage their finances, make their own medical decisions, etc. Still, sometimes a guardianship is unavoidable.

court investigator. A short investigator should speak to the proposed ward and others who may know something about the situation.

Hearing. A hearing date is scheduled and at the hearing the judge decides if a conservator will be appointed and, if so, who it will be.

Unless the proposed ward is medically unable to attend, the proposed ward must be present at the hearing, as the judge will often want to question him or her.

Please note that it is possible that another person, usually a family member, may object to the proceeding or propose a different guardian.

Inventory and Appraisal. Within 90 days from the date the judge signs the order appointing the probate conservator, the conservator must file a report with the court listing the assets owned by the conservatee.

More specifically, the conservator prepares an Inventory and Appraisal form. If there are assets other than cash, the conservator must send the Inventory and Appraisal to the probate arbitrator, who is appointed by the Court. The probate arbitrator will appraise the non-cash items, complete the Inventory and Appraisal by inserting the value of those items, and return it to the conservator, who must file it with the Court. It usually takes four to six weeks for the probate referee to return the form.

The estate is charged a fee for the appraisal, generally 1/10 of 1% of the total value of the conservatee’s estate, with a maximum fee of $10,000. The probate arbitrator can also recover expenses, such as mileage, in addition.

judicial investigations. Once guardianship is established, the court conducts periodic inquiries to confirm that guardianship is still needed and that the ward is being treated appropriately.

Bonds and Periodic Accounting. If the conservator is managing the conservatee’s finances (which is usually the case), the conservator must post a bond and provide periodic itemized accounts to the court listing all income and expenses.

Conservatee Status Reports. Often the conservator must also prepare periodic status reports indicating how the conservatee is doing and what the conservator is doing in regards to her duties.

Cost. Usually, the cost of guardianship comes from the ward’s income or other assets.

Conservator Fees and Reimbursements.

Bills. Generally, the guardian is entitled to reimbursement for reasonable expenses incurred on behalf of the guardianship, including expenses to establish guardianship and sometimes money spent to support the ward prior to guardianship.

With the exception of court filing fees and bond premiums, the guardian must obtain court approval before receiving any refunds from the ward’s estate.

It is essential that the conservator keep receipts and records of all expenses (and reimbursements).

The conservator may hire help as needed, such as an accountant, as long as the expense is reasonable compared to the size of the conservatee’s estate.

Generally, the guardian cannot be reimbursed for postage, photocopying, mileage, or the cost of travel to the court.

Time Compensation.

It is crucial that a conservator who wishes to receive compensation for his or her time maintains a detailed written record of time spent in conservatorship, indicating the date, amount of time, and entry-by-entry work performed.

Courts generally allow a family member to recover only for time spent managing the estate’s finances, and not for time spent acting as a family member (such as visiting the ward) or acting as the person’s guardian .

Courts may not allow compensation for time if little time has been spent on financial matters or if the guardian has failed to follow court procedures, including timely filing of accounts.

Some courts have schedules establishing the compensation a guardian can receive for his or her time, often a percentage of the ward’s estate.

The curator can only request compensation from the Court for the time after the last of both:

90 days after the letters of guardianship were issued; and when the Inventory and Appraisal is presented.

Alternatives

Notary Powers. Unfortunately, the process of obtaining and maintaining a guardianship is expensive, so we strongly encourage people to sign powers of attorney designating who will handle their affairs if they become incapacitated. If the proposed ward is mentally competent, by far the best approach is to have him/her sign durable powers of attorney. There are two types of powers.

Durable Power of Attorney for Finance. One type of power of attorney is a durable power of attorney for finance, which designates who can handle the grantor’s financial affairs (such as paying bills) if the grantor becomes incapacitated.

Advance Health Care Directive. The other type is the durable power of attorney for health care. In California, this is now known as an Advance Health Care Directive. This is designed to allow the grantor’s designated agents to make health care decisions if the grantor is incapacitated.

officers. Often the spouse (or partner) is the primary agent, and then adult children or friends are successor agents in the event the primary (or subsequent) agent is unable (due to incapacity, etc.) or unwilling to Act.

medical decisions. Often, if a person is incapacitated, the medical staff will allow family members to make medical decisions if everyone agrees. Representative Beneficiaries. Most government agencies allow another person (a “paid representative”) to receive checks for the payee and spend that money on the payee’s behalf. Each agency has its own application procedures and requirements. Many agencies require the paid representative to provide them with periodic accounts.

community property. If one spouse becomes disabled, the other spouse can usually manage all of the community property they own.

This will not help if action needs to be taken with respect to any separate property owned by the incapacitated spouse.

Also, even with community property, the capable spouse may not be able to roll over Treasury bills, sell stocks, or sell or borrow against real property.

Again, it is possible for the court to authorize the spouse to carry out specific transactions, but it may be easier to obtain a guardianship if continuing authority is needed.

That being said, for more complicated messages, you can use more characters, but try to make sure that the gist of your message is contained within the first 40 characters. Your mantra should be short, succinct, and punchy.

Talk: Mike Matheny’s letter to youth baseball parents

Mike is a man of strong character and shares his strong ethics with the players he coaches. I agree with about 80% of what he has said in the letter to the parents. I’ll give my opinion on a couple of things that I think Mike might understand.

When I was in the dirt with my players, I had very little parenting issues. The ages of the children that I was given the responsibility of coaching were between the ages of 12-15. Prior to that, I was part of a team of other coaches, working primarily with my son Jeff.

I had a parent meeting with a handout and explained the rules similar to what Mike says about player and parental responsibility. My parents were directly involved with my program and were part of the success. The team needed help with fundraising and travel arrangements. We were a baseball family and with the help of my coaches and associate coaches we were a formidable group. We weren’t a test team like a lot of the road teams in St. Louis. I had all the local guys and we won a lot and we were always able to win or compete against the selected teams.

My concern with Mike is on the subject of emotions. I can’t see a player who is a competitor who is busting his butt on the diamond not being able to show emotion. I would teach my players that when you make a label, you have to sell it. I’m a great competitor and most young athletes are the same way. If there is a play at second base and the runner is definitely out, the player showing no emotion is ridiculous! What needs to be done is for the coach to let the players show emotion, but not to show the referee by arguing. Players will never argue with the referees, the player can say “Got it” and then walk away and let the coach take care of the situation. That’s what a good coach is for, and he needs to approach the referee firmly and tell him I think you missed the call. Then smile and listen to what he says and then walk back to the bench. I think this is the perfect way to lead a youth team on this issue.

In my opinion, this level of baseball is strictly about player development. I told my players and parents that I was preparing my players for high school and beyond. He wasn’t as concerned with the referee calls as he was more concerned with playing the game the right way. We had a play where my third baseman dove to the left of him and threw to his knees to first; the ball was on the ground but was picked up. The referee said that the runner was safe. My trainers went crazy, I calmed them down real quick and told them that Ross and Brett did everything the right way. It was very good baseball!

I can’t imagine fans at a baseball game silently without shouting support for the players. I wouldn’t expect my parents or fans to act this way in a game. What should not be tolerated is arguing from the stands with a referee or verbally abusing the other team. When he was on the ground, he always managed the referees and always had the respect of the men in blue. Head coaches need to understand that they are in charge of keeping their entire baseball family in check. I can’t imagine “Come on, come on, you can do it” adds more pressure to the player. I think this shows support for the player and the team. I can’t imagine being at a baseball game and not hearing the fans rooting for the players.

Mike also writes about the loss of respect because kids hear their parents complain about teachers or coaches. Mike goes on to say that his father taught him that Coach is always right, even when he is wrong. I do not agree with this at all, I would not want my son to be a robot, yes, a person, so as not to think for himself and agree with a coach who is wrong. I think we need more people to stand up and say what’s right and what’s wrong. I must say that this is one of the reasons why I started this business: to improve training at all levels. I think the game of baseball should be played a lot better, and the reason it’s not better is because of poor preparation. I see so many mistakes at the major league level that shouldn’t be happening. I’m talking about the little things and also the basic things that major leaguers need to know. I have many veterans who feel the same way I do on this issue.

Bottom line, we need baseball coaches who are hardworking, honest, responsible, and really know how to teach the game. Mike is one of those coaches and I disagree with him on the emotions of the game.
