In some cases, a business model is based on the assumption that a patent portfolio will grant exclusive access to customers who wish to purchase a particular product or service. This supposed exclusivity can be a critical component in a business owner’s forecasts of market share, pricing, marketing costs, revenue, margins, etc. Whether these forecasts materialize or not depends on the actions of competitors. For example, if competitors are not hampered by the legal barriers expected by the patent holder, then market share and margins may well fall short of predictions. Too much of a gap between the expectations of the patent owner and the actual legal protection available can jeopardize the entire commercial enterprise. Entities investing in such a business model should carefully evaluate their target patent portfolios to determine if the portfolio has the strength to support business development and growth.

The patent review process is often referred to as “due diligence.” The fine points of due diligence can vary by industry. However, there are generally four common lines of inquiry that intellectual property professionals use when investigating the strength of a patent.

First, does the patent cover the current product? Patent applications are sometimes filed in the early stages of development of an innovative offering. Invariably, the technical characteristics of a product may change during testing or in response to feedback from a supplier or consumer. However, one of the “hard and fast” rules at the Patent Office is that the content of an application cannot be supplemented after filing. If a concept evolves in a direction not contemplated by the original patent application, then the commercialized version of that concept could become unprotected. Therefore, it is always prudent to compare the valuable features of the existing product with the content of its corresponding patent.

Second, is the patent relevant to competitors? A patent does not necessarily protect all that is reveals. For example, the fact that a commercialized product is shown in great detail in the figures of a patent does not translate into robust protection for that product. Take a scenario of an innovative “baby-friendly” handle that a parent can purchase to add to an existing bottle. It could happen that the patent describes the handle but only “claims” the handle in combination with the bottle. The gap in protection is that a competitor can avoid infringing this patent by copying and selling the new handle. without the bottle. As unfair as it may seem, if the competitor does not sell what the patent claims, there is a risk that the patent cannot be successfully enforced against that competitor. Claims are simply the name of the game. Therefore, it is best to examine the claims of a patent to ensure that there is a “one-to-one” match to what competitors are likely to sell.

Third, is the patent the correct geographic scope? Some companies choose to maintain only a national patent portfolio, while others choose to supplement their national protection with patent rights in other nations. Depending on the market, either approach may be the appropriate course of action. For example, because the European Union (EU) wields as much economic power as the United States, the rationale for introducing a product to the US market may apply just as strongly to EU markets. If so, the relatively high costs of obtaining patent protection in the EU may be justifiable. On the other hand, cultural differences or government regulations may make it unprofitable to enter markets outside of the US. In such cases, it may be better to focus financial resources for patent protection only on domestic opportunities. From an investor’s point of view, one concern might be whether the company has foregone potential foreign revenue streams due to inadequate patent coverage in those foreign states. On the other hand, one consideration might be whether the company is saddled with onerous overhead costs (e.g maintenance fees) for having acquired unnecessary offshore patent rights.

Fourth, is the “history” of the patent pristine? Securing patent rights involves filing numerous legal documents within prescribed time frames. In addition, errors or deficiencies in the content of these documents may cloud the validity of the patent or raise doubts about ownership. For example, the US Patent Office requires inventors to disclose prior publications that may be relevant to patentability. In some circumstances, failure to submit these publications may result in a patent being unenforceable. With regard to ownership, failing to properly document the transfer of ownership rights from an inventor to another party, such as the inventor’s employer, could make a patent unenforceable. Therefore, no “due diligence” is complete without first examining the documents associated with a patent to locate potential “land mines.”

In the end, a prospective IP buyer should have the same mindset as one considering buying a home or commercial property. A prudent real estate investor would never be satisfied with “conducted” inspections or “swifting” a deed or loan documents. Such an investor would also not rely on the alleged owner’s verbal assurances. Instead, the investor would walk through the property with a critical eye and have legal professionals examine each contract, deed, or loan. The investor would have a certified inspector determine the safety and physical condition of the property. Similarly, investors in patents must implement similar measures to determine whether a patent will live up to their expectations.

(Entry #5) I’ve never felt so old

I had an epiphany this morning. I realized why the elderly are always so irritable. Aside from the fact that they must be upset seeing young people do stupid things, they are most likely experiencing some kind of pain in their bodies. The more they try to live among the young and do young things, the more pain they are likely to experience. It hurt in places I didn’t even know I had.

To say that I am sore from yesterday’s training session would be an understatement of monumental proportions. When I went to bed last night, I couldn’t find a comfortable enough position to sleep. I thought about walking to the Family Mart and getting some ibuprofen, but that would have meant going up a flight of stairs. Needless to say, it was another sleepless night. However, I think I watched all the Muay Thai documentaries on the web, so it wasn’t a waste.

As the sun came up, I was able to muster the energy to get out of bed, and my high Muay Thai got my blood flowing enough to make it through another session. I call it a muay thai high, because there’s something about it that touches my heart in a way few other things ever could. I love muay thai. I love being close. I love hearing it, watching it, and nothing makes me feel more alive than getting punched in the face.

I was definitely moving a little slow during the race to start the class. There were a couple of ten-year-old Thai boys from the competition team who were also running. They would run past me, then when they were out of sight of the trainers, they would walk for me to pass them. When we would go back to where the trainers were, they would run past me to get yelled at by the trainers for letting me past the little kids. They laughed a lot about it.

After warming up, I was paired up with the Goliath-sized German for training. Apparently his name is Mustafa, not Lucifer as I wrote yesterday. It’s so big that I couldn’t hear what he said as far as my ears are. However, he is a good partner to train with. I started chatting with him for a while. It looks like we’re going to be here for the same amount of time, so we’ll be seeing each other a lot.

They also matched us up for sparring. It was a clinch match today, so it’s all an inside job. It was a fort as it seemed. I just had a lot more experience than him in riveting. The rounds would go like this. He would move hard, and I could get angles and score on him. Then he would tire me out, and he would brute force me and rag doll me until the end of the round. All three rounds went more or less the same way. If it was a fight, hopefully I could have finished it sooner, because if not, he would have kneed me until next week.

During the pad rounds, I was able to work with a trainer I had never worked with before, but always wanted. He looks like a curmudgeonly old man, but he’s strong as an ox. I’ve seen him hold giant pads, and they can’t move him. He pushes you beyond your limits. I have seen him beat up the Thais when he is training them. He accepts nothing but the best of you. He pushed me to the brink of throwing up today. I literally had to stop the round and go dead over the wall. When this happens, all the other trainers support the trainer who made the ‘Farang’ vomit. I could see them over my shoulder giving him a thumbs up. Other than that the rounds were amazing. When I came back after throwing up, I had such a burst of energy that I finished the round with some of the best Muay Thai I’ve ever done.

Today I am very sore again and I am going to have a Thai massage. Without them, I don’t think I could get through this. They are my little piece of heaven in a week that feels like hell. Besides Muay Thai, Thai massages are the thing I miss most about Thailand when I’m in the United States. I’ve been to a few massage places that claim they do Thai massage, but it’s always ended up being like going to McDonalds for good Thai food.

The lady in the chicken coop stopped me on my way back from training. She invited me to go to a Buddhist ceremony very early the next Tuesday morning and then she asked me to help her feed the monks when they came to bless her chicken coop the next day. Apparently a lot of them come, and she wants to make sure they’re all well taken care of. I am very excited to be included in something so important to her.

Next Thursday is Songkram, the Thai New Year. Here is a bit of information about it.

It’s basically a national fight for water. Tiger is closed that day, and everyone will be spraying each other with squirt guns or throwing water balloons. Everyone around here is very excited about it. It sounds like a lot of fun.

How to get the most out of your criminal defense lawyer

You have found a lawyer you like. He or she seems incredibly smart and knows the law inside out. Now you must decide one thing: How can I use this person’s abilities to defend myself against a criminal charge?

In less serious criminal cases, there may be alternatives to Plead Guilty or Go to Trial. For example, in some misdemeanors, the law allows for a “Misdemeanor Compromise” where the Defendant and the Victim agree to settle the matter between themselves. You can often see this in third-degree robbery cases, such as shoplifting. The thief agrees to compensate the store owner and the store owner agrees that the criminal case can be dropped. There are other examples of this, such as a pretrial diversion agreement. In a PTDA, the defendant agrees to do (or not do) certain things and if he or she complies, then the case is dismissed. Unfortunately, alternative resolutions are not available in all cases.

In many criminal cases, there are legal questions that must be answered by a judge. The most common questions involve whether or not Prosecutors can use evidence against a Defendant. Examples may include: statements, test results, or other physical items.

Either Party can ask a judge to rule on whether or not something will be allowed as evidence. This is usually done at a Motion Hearing. As the Defendant, your job is to understand what is at stake during the Motion Hearing and whether or not there is any risk in having the hearing. The outcome of a Motion Hearing can range from having no impact on your case to requiring the dismissal of the charges against you.

The final arbiter of justice is trial by jury. Whether or not your case is worth going to trial is something you should trust your lawyer for. The outcome of a trial is easy: either you win or you lose. If you win, then the case is over and you are done with the court. If you lose, judges tend to give you a little more jail time and a little more fines than you would have gotten if you had simply pleaded guilty. Whether a judge will do that in a particular case depends on how things went at trial. If you had a good case but the jury found you guilty anyway, a judge may take that into account when sentencing. I have certainly had cases where we went to trial and lost, but my client ended up with a better sentence than he would have received if he had pleaded guilty early.


Speaking with an experienced and aggressive attorney can take an incredible amount of stress out of your case. It can also create a problem: The temptation to let the “professional” handle your case. Don’t fall into this trap. No matter how smart or well educated your attorney is, he or she will not be able to get the resolution you want if they don’t know what it is. Your lawyer will count on you to keep them informed of your needs and wishes just as much as you will count on your lawyer for good advice.
