Workers Compensation Lawyers

Workers’ compensation cases are more complicated than most others. Any commercial and industrial business that has more than three employees must have workers’ compensation insurance. That system is covered by the Industrial Commission. That’s a state agency that makes sure everyone follows the rules. That means you may be entitled to your workers’ compensation benefits if you are injured on the job. It must be tried before you actually get the benefits. There is a process you have to go through.

When you are injured on the job, you must tell your boss by giving written notice. The notice must be written within 30 days, but you have two years to file it. After the two years are up, so will your ability to file the claim.

Generally, when an employee is injured on the job, workers’ compensation is the only way to fix it. This is because, on rare occasions, injured employees are not entitled to any other avenue of compensation. It is easy to get workers’ compensation because whether it is the fault of the employers or the employees, most of the time the attorneys will compensate the employee. It doesn’t really matter who is at fault. It is serious for a worker to be injured on the job, whether due to the negligence of the employee or the employer. Employers used to be covered even for contributory negligence that blocks liability. When the worker wins, he receives paid medical bills from the insurance company that also include prescriptions. The insurance company may contact the medical providers you are already seeing, although you may submit a request to change.

The worker will receive disability benefits from the insurance company. Disability payments are two-thirds of employees’ gross weekly wages. Workers’ compensation payments are also not taxable. If it is more than a seven-day period, the insurance company will start paying per day every day until the employee returns to work, provided he has a written note from his doctor saying he is unable to work. The worker will not collect payment for the first seven days until 21 days have elapsed without returning to work. Permanent partial disability will take effect if a worker is permanently disabled. Only then is the worker entitled to lifetime benefits, including medical expenses and disability payments. Workers’ compensation, although it will award you a fraction of his salary, does not work the same way as other injury claims. You will not receive pain and suffering.
