Wednesday September 21, 2016. That day my life gave me a good blow. He tapped into my most innate emotions and showed me how unexpected life can be.

Every day I walked a short distance from my house to my math tuition. I took it from her hand and put it on the table. I picked him up and flipped him over and tried to resuscitate him all the while yelling his name. When a minute or more had passed since I entered, I ran to the living room and informed the aunt about what had happened. Soon there were a dozen people at the entrance to the room. We got him out of the room and waited for the requested ambulance, but time was of the essence. So we put him in the car with the aunt and some other people, and they went to the hospital, but I knew better. Even when they pulled him away, I saw his face, with lifeless eyes and an unchanging expression, I knew he had been dead for a long time. The salon staff, the security guards across the street, and just me left. They asked me to close the basement door, handing me the keys. With trembling hands and a hard-pressed mind, I closed the room, gathered up my slippers that had somehow broken in the process, and went home. I walked into an empty room and I cried, I cried until I lost my voice. After that I was silent. It was only at midnight, when my parents were really worried about me, that I recounted the tragedy. That night I did not sleep. I kept thinking about what could have been. If only he had come earlier, if he had maybe called him before he came, could he have saved him? I personally understand this because I can get very seasick when traveling in speedboats, small boats or catamarans if I don’t take the necessary precautions. For me, these precautions involve taking a motion sickness prevention product called Bonine (for adults and children) that you can buy at any pharmacy or department store like Target or Walmart (but use only as directed). Personally, I haven’t had any problems with seasickness on cruise ships (even when we’ve experienced very strong winds or waves and the ship was really rocking).

2. Why do you want to take a cruise vacation?

A. Why do you want to experience a cruise?

PROS:

Cruise ships are like four-star floating resorts and are so much more than just a vacation. They are an experience like no other vacation you have ever had. Cruises are a great value as they are “all-inclusive” vacations that include your transportation to different ports (when you would otherwise have to book additional airfare), your hotel (since you always have your stateroom), and your meals (offered 24 hours a day). /7 on many cruises). They are one of the best travel deals you can get for a budget vacation when you add up what it would cost to do a similar vacation with additional airfare, hotels and meals, not to mention the quality of the accommodations.

You can make your cruise vacation whatever you want it to be. Your days on a ship can be packed with activities from morning to night or you can just relax, shop and sunbathe by the pool, or just hang out in your stateroom. And when you arrive at each port, there are also dozens of shore and shore excursions for you to take.

CONS:

If you are single or have a partner without children, you may want to avoid taking cruise vacations during a season when there are no classes (especially during spring break) or traveling on a cruise line that caters heavily to the families. If you have a family, make sure you don’t choose a cruise line that caters to seniors (including senior citizens) and isn’t kid-friendly. Several cruise lines have programs for children that travel free (or offer this discount periodically, such as MSC Cruises and Costa Cruises) and these are good cruise lines for you to investigate.

B. Because you like the cruise itinerary and ports of call?

PROS:

One of my favorite things about a cruise vacation is that you can visit so many different destinations on one cruise, without having to repack, and all for one incredible price! On a recent 10-day Western Caribbean cruise, I had a balcony stateroom and went to the Cayman Islands, Colombia, Panama, Costa Rica, and Mexico for a total of $535 per person (including port fees and taxes!) ! This cruise itinerary was perfect because I had just the right amount of time in each port city and country we visited.

CONS:

Now, from the good to the bad to the ugly when it comes to choosing a cruise vacation based on your cruise itinerary. I took an incredible 8 day Mediterranean cruise from Barcelona with ports in Naples, Rome, Florence, Nice and Marseille. I had never been to Spain, Italy or the South of France, so this was a great itinerary to begin with. What I discovered, and what you need to be aware of, is just how limited your time can be when porting. Usually the port time is no more than 10-12 hours. For example, when I arrived in Rome from the port (a 60-90 minute train ride), I only had seven hours for sightseeing. You definitely need much more time than that to see everything the city of Rome has to offer and visit the highlights (Vatican, Sistine Chapel and Colosseum).

On cruise vacations, you should also be prepared that you may occasionally be unable to board due to inclement weather. This is what happened with Florence, so I couldn’t get my proverbial photo holding the Leaning Tower of Pisa. All that said, I had two weeks of incredible experiences packed and condensed into four days on the ground, including being struck down by the Pope in St. Peter’s Square in Rome and standing just 12 feet away from him when he passed by in the famous “Pope Mobile.”

C. Both A and B. Because you want to experience a cruise and you like the cruise itinerary?

PROS CONS:

There is one tricky part of planning a cruise vacation if you want to experience cruising and wonderful ports of call and that is where in the world do you want to go? With hundreds of different ports to choose from, you can find the cruise vacation of your dreams with cruises around the world, including Alaska, the Caribbean, Mexico, Europe, Asia, Bermuda, Hawaii, New England and Canada. But no matter where you decide to go, seeing the world on a cruise vacation is unlike any other trip.

Spousal Support Waiver Defense – No Laches Anymore – May Ban Collection of Arrears

Prior to the January 1, 2003 amendment to California Family Code section 4502, laches (unreasonable delay with undue prejudice) was a defense to the collection of spousal support and child support. But on January 1, 2003, Family Code section 4502(c) eliminated the laches’ defense to back spousal support and child support. And while the aforementioned section 4502(c) was later struck down by the California Legislature, Family Code section 291(d) was enacted as a replacement.

In an action for enforcement of judgment for child or spousal support, the defendant may oppose, and the court may consider, the defense of laches only with respect to any part of the judgment that is due towards conditionunder Family Code Section 291(d).

Therefore, the alternative defense of waiver under California Civil Code section 3515 may be available to prohibit the collection of spousal and child support arrears, but no longer laches.

Delay inconsistent with intent to enforce right to support:

With the laches defense of common law for the collection of spousal support eliminated by the California Legislature, the laches defense set forth in Plescia’s marriage (1997) 59 CA 4th 252, 257-258, 69 CR 2d 120, 123-124, and in In re Marriage of Lamb (2007), 95cal. app. 4th 653, 115 cal. Rptr. 2d 787, is no longer good law.

This leaves the defendant-debtor spouse with the waiver defense. Waiver has been defined as “the intentional waiver of a known right or such ride that merits an inference of the waiver of such right, and may result from an express agreement Prayed be inferred from the circumstances indicating the intention to resign,” according to Panno v. Russian 82 cal. app. 2d 408, 412, 186 P. 2d 452.

In In re Marriage by Paboojian (1987) 189cal. app. 3d 1434, 235 Cal Rpt. 65, the Court of Appeals ruled that: “although the evidence of an express waiver is equivocal… (the) delay (the lack of demand for court-ordered child support for almost 16 years) in itself is not a defense of the right to enforce increased payments under the divorce decree, (citing DiMarco v. dimarco (1963) 60cal. 2d 387, 294, 33 cal. Rptr. 610), (b) but the delay is so inconsistent with the intent to assert the right to support that it substantiates the trial court’s decision for a waiver.”

Acceptance of a lesser amount of support and delay of 4 years without exemption:

However, it has been ruled hammer v. Hammer (2000) ___cal. app. 4th ___, that “mere acquiescence in paying an amount of child and spousal support less than that provided by a final dissolution judgment (is not) sufficient to constitute a waiver or prohibit collection of unpaid amounts” .

In hammer v. Hammer, upthe Court of Appeals found that… “it simply cannot be said that the four-year delay in the present case – especially in the absence of an express agreement to waive collection of the unpaid amount – was” ‘conduct so inconsistent with intent to assert the right in question to induce a reasonable belief that it has been waived,'” citing paboojian, up.

The passage of time is not enough in laches and waiver defenses:

As indicated in paboojian Y Hammer, up, the mere delay or passage of time is not enough to waive or prohibit spousal support. There must be a lack of intention to assert the right to aid, either by express agreement or an influence of circumstances indicating an intention to renounce, for Graham v. graham, (1959) 174cal. app. 2d 678, quote Panno v. Russian, up.

The same is true in the defense of eliminated laches. In fact, laches implies an unreasonable delay that causes undue prejudice to the party presenting the laches defense, according to Plescia’s marriage, up.
