2. Position yourself as the Victim of the Problem and the Only One Who Can Possibly Solve It

It is crucial that the distinction is made without saying: you caused the problem and they are its victims, which makes you feel that you are wrong and that you are the bad guy. Unless you take action to remedy it, you did it on purpose and you enjoy hurting him.

It’s “solved” because they feel better and they successfully screwed you over. The issue has served its true purpose by covering up the real issue and can now vanish into thin air.

They feel better because now they have their release, they no longer feel so self-conscious, and their image of themselves is not only intact, but strengthened and unblemished. However, yours is not and you are worse off now than before this “problem” arose.

The problem was that they felt bad and needed to dump it on you. They throw it away because they can’t express it, much less acknowledge it themselves. All they know is that they feel bad and abusing you makes them feel better.

Solving the problem makes things worse for them and for you. They won’t get their release, they’ll feel bad and find another way to vent to you, maybe with the same problem but probably with a new one.

Pipeline Detectors and New Construction Coordination

Pointing fingers, passing the buck, shifting responsibility… This seems to be a common theme when it comes to installing duct smoke detectors on new construction projects. Mechanical, electrical, fire contractors… Who is responsible for making sure these detectors are installed correctly? Perhaps this confusion is due less to the working range of the detectors and more to the uncertainty felt by contractors regarding the proper installation and location of such fire protection devices. I wish I could say otherwise, but the answer regarding responsibility is probably not as simple as we would prefer. Like many other endeavors on a construction site, installing duct smoke detectors requires a coordinated effort among all parties. The mechanical contractor is usually responsible for mounting the detectors. Still, he’d hope he didn’t want anyone else cutting and plugging his ductwork. The electrical contractor is often required to run conduit to the detector location and is often required to manage the subcontract for the fire alarm company. Ultimately, the fire alarm contractor is responsible for making sure the device is working properly and reports to the fire alarm control panel. Coordinate effort.

NFPA 90A, where needed

NFPA 90A is the standard for air conditioning and ventilation systems. This code states that an duct smoke detector is required on the SUPPLY side of any HVAC unit greater than 2000cfm. Those detectors must be located downstream of the air cleaners and before any bypass connections. If you can’t get ahead of any branch connections, you must have one at each branch. In addition to the supply side detector, NFPA 90A states that an duct smoke detector is required on the RETURN side of any unit above 15,000cfm. These detectors are required on each floor prior to connection to a common return and prior to any recirculation or fresh air intake. They are not required when the entire space is protected by smoke detection in the area.

NFPA 72, Installation Media

NFPA 72 is the National Fire Alarm Code, the standard for the installation of fire alarm system components. First, NFPA 72 reminds us that duct smoke detectors are NOT a substitute for open area detection. NFPA refers to the manufacturer’s published instructions for installation requirements. Manufacturer’s instructions advise that duct smoke detectors be located a minimum of 6 duct widths from a curve or other obstruction. This means that if you have an 18″ wide conduit, the detector must be located a minimum of 9′-0″ downstream of a bend or other obstruction. This is often difficult to achieve. The contractor should be aware that the 6 duct width guideline is based on the fact that the airflow is interrupted when it reaches a bend. The duct detector requires air to flow through a 1/2″ diameter sample tube that protrudes into the duct. If the airflow bounces around the entire duct, it is less likely to reach the sample tube as is required for proper conditioned smoke detection.Because the code states that it “should” rather than “shall” be located in a minimum width of 6 ducts, it is the contractor’s responsibility to use their best judgment in locating the detector as far Since HVAC ducts are often located above the finished ceiling or high on joists out of visible range, the location of smoke detectors in the duct should be permanently identified and recorded, and location. Firefighters and service personnel must be able to identify the location. Where duct smoke detectors are installed greater than 10′-0″ AFF or where the detector is not visible to responders, they must be provided. Provide remote indicators to easily locate the device. On occasion, when acceptable to the AHJ, remote indicators may be eliminated if the detector is specifically identified and clearly announced on the FACP and annunciators.

Alarm shutdown/supervisory and fire alarm

Once duct smoke detectors have been sufficiently installed, there appears to be an ongoing debate as to whether the detectors should annunciate a supervisory signal, which requires an investigation to determine if there is a fire, or whether the detectors should announce an alarm signal. immediately evacuate the building and call the fire department to the scene in response. Proponents of the supervisory signal argue that duct smoke detectors are a common source of false alarm signals. Often when heaters are first turned on at the beginning of winter, the heat blowing through the ducts burns off the dust (we all know the smell of the heater being turned on for the first time), causing an alarm. Neither the owners nor the firefighters want to evacuate the building or take trucks to a site that turns out to be a false alarm. On the other side of the argument, however, is the concern that if the detector is activated and then doing its job, an alarm signal is required to ensure the safety of the occupants. No risk allowed. Because there are valid points on both sides of the argument, NFPA 72 has chosen to take the middle ground and allow this to be a local decision. The Fire Alarm Code states that duct smoke detectors can be EITHER alarm-initiating OR supervisory-initiating. The local AHJ will most likely have a preference. The only definitive action supported by the code, per NFPA 90A, is that duct smoke detectors must automatically stop their respective fans; and that each time a duct detector is provided, it must be reconnected to the building’s FACP.

Duct detectors and clean agents

Another question that often comes up regarding fire systems is how duct detectors play into clean agent suppression systems. Clean agent systems have their own control panel and require a means of fire detection before discharging a fire extinguishing agent. The question arises when a duct detector is provided in the CRAC unit installed inside a computer room that is protected by a clean agent system. Who monitors the status of the smoke detector in the duct and its alarm activation influences the clean agent distribution sequence? Let me answer the first question by explaining a bit about the second question… NFPA 2001 is the standard for clean agent suppression systems. This standard requires forced air ventilation systems to be shut down ONLY where their continued operation would adversely affect the performance of the fire suppression system. Additionally, the standard states that fully self-contained recirculating ventilation systems (ie Liebert or CRAC units) will not be required to be turned off. This is because air recirculation within the protected space does NOT negatively affect the performance of the extinguishing system; in fact, it helps in the retention time of the agent in the atmosphere. The continuous recirculation of air within the protected space actually helps to extinguish the fire and prevent re-ignition. That said, duct smoke detectors play no role in the clean agent delivery sequence. Since the duct smoke detector is not part of the clean agent distribution sequence, it is not linked to the clean agent fire panel. The detector should now be connected to the base building’s fire alarm control panel. Whether or not activating the detector causes the unit to turn off is now an optional decision by the owner, although it is not recommended in this case.

The eviction process

Evicting a tenant is obviously not an exciting part of real estate investing for the tenant or landlord. What follows is a description of the eviction process itself (especially as it relates to what to expect in Ohio), punctuated with some of my personal comments regarding how I typically handle evictions.

Generally, if I haven’t received rent money from a tenant by the 8th or 9th of the month, I call the tenant. My leases stipulated that the tenant has a grace period until the 5th of the month to mail rent money without being charged any late fees. As long as the envelope is postmarked by the 5th, there is no late fee. Allowing 3 or 4 days (starting on the 5th) for a renter’s payment to arrive is quite liberal and enough time to allow money to be received from intercity mail.

If when calling the tenant I think we are going to have problems, I immediately give a 3 day notice to the property. A copy of the notice is made prior to delivery. The 3-day notice is posted (taped) to the front door of the property if the tenant or other occupant is not there when it is delivered. Any tenant who reaches this point (the start of the eviction process), is advised that the 3-day notice is simply posted as a way to protect my interests in the event that the tenant fails to honor any outstanding money owed.

Attaching a 3-day notice to the tenant’s door does not adversely affect the tenant’s public record. It is not until it is formally filed within 3 days that it becomes public record. The landlord cannot file for eviction until 3 business days have passed from the time the 3-day notice was posted on the property. Once the 3 business days have passed, the landlord can begin the formal eviction process. How does this start? He will take your paperwork, including a copy of the 3-day notice, and present it to you for an eviction hearing. I use an attorney to process all of my evictions. Specifically, one specialized in the processing of evictions. Personally, I prefer to use an attorney who tries to remedy the situation with the tenant before the case is heard. You do not have to use a lawyer; You can do a lot of this yourself and save a few bucks, but I highly recommend using one. If you have never been to your local court system for eviction hearings, I highly recommend it. You’ll quickly get an idea of ​​what happens during these hearings, and you’ll know what to expect ahead of time if you ever get to the point of processing an eviction on one of your own properties.

You can expect about two weeks to pass before your hearing is scheduled. It is important to note that I always keep the line of communication open with the tenant throughout this process. I think this is extremely important. I want the tenant to know that I don’t like going this route as much as the tenant. It is not my goal to kick a tenant out of the property. In fact, I go to great lengths to reach payment agreements or even payment assistance resources with the tenant in an effort to get them back on their feet. Yes, it may take a little help and some of your extra time, but I’d say eight out of ten renters who go through this extra help will appreciate your attempt to help and will ultimately settle their past due balances with you. You walk a fine line here with the tenant in that he or she may also be taking advantage of you. It can be a difficult decision. Sometimes it can just come down to trusting your gut with the situation.

If a ruling (in your favor) is made at the hearing, the judge will give you permission to put a “red tag” on the door. A red tag is just that: it’s bright red and marked with the date that possessions will move from the property if the tenant hasn’t vacated. The tenant has five days from tagging to leave the property. It will usually take him 2-3 business days after the court hearing to place this tag on the front door of his property. Again, I keep the tenant aware of my intentions during this process. You, as the owner, make the decisions regarding whether or not a potential stake occurs. I mention to the tenant that I do not wish to leave the property curbside yet, and if payment arrangements can be made, exit can be avoided. Again you will have to make the call here. Do you want to accept only a partial payment of what is owed and try to arrange a plan to pay off the extra money? Or do you think the tenant just won’t make it and in this case will go ahead with the eviction process?

The final step is the dreaded stakeout. It is extremely rare that it ever has to get to this point. If it gets this far, frankly the tenant deserves it. I have given them every reasonable opportunity to try to remedy the situation or move out of his own volition. If the tenant has not moved out by the date stated on the red tag, you, as the landlord, have the right to order an exit with the bailiff. Again, an attorney who specializes in evictions really helps here. In Columbus, Ohio, you only have a two-hour window Monday through Friday to request and schedule a ride. Also, staking must be scheduled within ten days of the red tag, or you must apply for a supplemental red tag (more money).

When release is requested (usually a day and time agreed upon by you and the bailiff), you are expected to have at least four people dedicated to removing furniture and belongings from the home. You will also be asked to have garbage bags and boxes to pack the items before you take them out of the house. It will be helpful to have good maintenance workers when you get to this point.

As you can see, evictions can be quite a lengthy process, usually taking three to four weeks to complete. This is why I believe it is very important to always maintain good lines of communication with your tenant and try to be as professional as possible in handling the situation. It will be frustrating!…but try to keep an open mind about ways you can help your tenant get through this. A good, positive attitude can go a long way in making this process less stressful for both you and the tenant!
