What is a brand?

At one time or another, we’ve all seen a product or company name with a little R in a circle floating next to it. You’ve probably wondered what this R symbol actually stands for and how exactly it got there in the first place. Most people will tell you that it means something like “registered”, but that’s only a small part of the meaning behind the circled R.

It is correct that this symbol implies the term registered, but registered with whom and how?

A “trademark”, or ®, refers to a name, slogan or logo that has been officially registered with the United States Patent and Trademark Office (USPTO). Registering a trademark is beneficial to a company because it publicly states that their trademark is registered with the USPTO and therefore they have exclusive rights to that name within their industry. This means that if your business was trademarked and you found another business of a similar nature using your name or logo, *you would probably have a legal right to use your name!

Every time a person applies for a trademark, the USPTO cross-references their name and/or design for similarities. ONLY among federally registered or pending trademarks. The USPTO search is not found in the U.S. national common law AND state trademark databases! Because the USPTO protects names in this way, you are not at risk of being used and possibly tarnish the reputation of the company you worked so hard to build!

Once you have applied for your trademark, the USPTO will consider it a pending trademark for up to 18 months. This is one of the many reasons why it is important to apply for your trademark sooner rather than later. The sooner you apply, the sooner you’ll be doing business under a registered and protected name!

* This depends on whether the name is actually available at the time of submission. In other words, was there a prior federal or state trademark? Was there an earlier use of the name in Common-Law?

What doesn’t kill me, (actually) makes me stronger

Friedrich Wilhelm Nietzsche was mad about his death, the way he ended the last almost eleven years of his life; but he is credited with the saying: “What does not kill us, makes us stronger”, and “What does not destroy me, makes me stronger”, and variants.

This man was a fervent enemy of Christianity and never saw the light of Christ, but I think he certainly got a lot right in philosophy, including this one.

And this quote is completely biblical. We can find bible verses upon bible verses to support the fact that Nietzsche was actually propounding the Word of God even though he hated Christianity and the thought of God. (For starters, see John 16:33; James 1:2-4; Galatians 6:9 and many others like it).

Everything we patiently endure in life eventually turns to our advantage. And this is where faith comes in. The faith of trust, hope, courage, boldness and confidence. Nietzsche therefore had faith and possibly a faith based on God, although he never knew it. He would call on the Biblical Wisdom tradition to support this claim.

The faith that gets us through the toughest times with a “what doesn’t kill me makes me stronger” approach requires hope, a sense of love (at least self-love), courage, and more.

However, it is only when we look back that we can see ‘after’ how far we have come and how much we have endured. In fact, Hebrews 12 attributes the difficult times of life to the loving discipline of the Lord, and the key to our perseverance is humbly accepting his love to grow us to maturity. Verse 11 says, “No discipline seems pleasant at the time, but painful. Later, however, it produces a harvest of justice and peace for those who have been trained in it.”

We must remain and abide in God no matter what happens, even when it doesn’t make sense. What doesn’t kill me inevitably makes me stronger because God loves me so much that he wants me to reach my potential.

Yet it seems heartbreakingly untenable to think about how difficult some situations of loss and difficulty can be; however, this truth still holds; it’s not just a cliche. We will survive and we will be stronger if we endure.

Children’s craft recipe for homemade bubbles:

3 cups of water

1 cup dishwashing liquid or baby shampoo

1/3 cup light corn syrup

Mix everything together in a large bowl. Instead of using dishwashing liquid, I use Baby Shampoo. This will not sting children’s eyes if the bubbles splash into their eyes.

The REO Formula – Real Estate

To clarify, let’s describe what Real Estate Owned or “REO” is. Real estate seized by an Institutional Lender (primarily banks, mortgage companies, insurance companies, etc.) and now owned by that Lender is REO property. Most lenders have an REO department within their company, usually managed by an REO officer, bank employee, or another lender. Lenders definitely do not want to own properties that they have had to foreclose on. They are under pressure from federal and/or other banking regulators to divest these properties. This also reduces your ability to make new loans.

Today, short sales are a very popular method of buying these foreclosed (or about to be foreclosed) properties from banks. There is another method or technique that has been used by real estate investors for many years which is known as the “REO Formula”.

Let’s see an example for the use of the REO Formula.

Let’s say you’re a real estate agent with a very active and wealthy investor client who owns multiple properties and is always looking for a way to acquire more properties and/or raise cash. It seems that many investors always need cash to make another “deal”.

Let’s say your client owns several parcels of good land to develop. You would like to acquire more income-producing properties. You learn from one of your official REO contacts about a small apartment complex for which the bank would accept $250,000. He knows that the fair market value of the units must be around $350,000.

After consulting with his client, he comes up with the following proposal to the bank:

1) Your client will exchange development land valued at $250,000 to the bank for the apartments, provided the bank lends your client $175,000 (70% LTV) in cash for the apartments.
two) Your client will then buy back the land from the bank with a down payment of $87,500 and the bank will lend the balance of $162,500 (65% LTV).

Let’s see the benefits for both parties:
A. YOUR CUSTOMER
1. You have completed a tax-deferred exchange of your development land for the apartments.
2. You have $87,500 in cash that is also tax deferred.
3. You have traded idle land for income-producing property.

B. THE BANK
1. You have traded one unwanted REO property (one bad loan) for two good loans from a capable borrower.

Another way this could be structured could be for the bank to make the loan on their client’s land. Then your client could buy the apartments with a down payment and a loan from the bank. However, using this method would not have the same tax benefits. Please note that I am not giving tax advice here. Randy Moss – A Brief Biography

This article is one of a series of articles written about some of the current New England Patriots players. In this article we will look at the life and football career of Randy Moss, the star wide receiver for the Patriots. While some of his transgressions off the field are well known, his stature as one of the best wide receivers in NFL history is indisputable. Let’s examine the biography of Randy Moss.

Randy Moss was born in Rand, West Virginia, on February 13, 1977, to Maxine Moss and Randy Pratt. Rand was a small mining town, not the kind of town you’d expect to produce one of the NFL’s biggest stars. Rand was so small that they didn’t have their own high school. Therefore, Randy attended high school at the now-defunct DuPont High in nearby Belle, West Virginia.

During his high school years, Randy excelled at sports. His favorite sports were soccer and basketball. He helped bring his team state titles in both football and basketball during his junior and senior years. Due to his excellent performance in football during his high school years, college football powerhouses took great interest in him. The main universities that showed interest in Randy were Ohio State, Notre Dame and Florida State University. Notre Dame’s Lou Holtz said that “Randy Moss was the best high school football player he had ever seen.” In 1995, Randy signed a letter of intent to go to Notre Dame on a full football scholarship.

Racial tensions ran high at the high school Randy Moss attended. These tensions resulted in many fights at DuPont High School. After signing to go to Notre Dame, Randy got into one of those racially motivated fights. This resulted in Notre Dame rescinding his scholarship. Lou Holtz suggested to Bobby Bowden, the head coach at FSU, that he give Randy a chance. So Randy intended to go to FSU on a full football scholarship. However, due to his signed letter of intent at Notre Dame, the NCAA considered him a transfer student. This made him ineligible to play for the Seminoles in the 1995 football season. So in 1995, Randy wore a red shirt.

In 1996, due to some transgressions off the field, Randy was fired from the state of Florida. He ended up never playing for FSU. He then needed to make a decision on where to play his college football. He considered Marshall University, which was only a couple of hours from his hometown. Randy knew that Marshall was moving from a Division 1-AA to a Division 1-A, which would mean tougher competition and more exposure to NFL scouts. I am sure this influenced his decision to attend Marshall.

During the 1996 season, Randy broke many records as a freshman at Marshall. This included most games with a touchdown reception in a season (14), most consecutive games with a touchdown reception (13), and most catches for touchdowns in a season (28). He also broke the record for the number of receiving yards gained by a freshman in a season (1,709 in 78 receptions), a record that still stands today. He helped Marshall win the Division I-AA schools national championship.

Randy also played soccer at Marshall during his sophomore year. This was the University’s first year as a Division IA school. During Randy’s two seasons at Marshall, he broke many NCAA records. Overall at Marshall, he scored at least one touchdown in the 28 games he played. He won the Fred Biletnikoff Award as the best wide receiver in the nation and was a 1997 Heisman finalist. He finished fourth in the voting that year, behind Ryan Leaf, Peyton Manning and Charles Woodson. Not bad considering Randy was just a sophomore. Charles Woodson, the University of Michigan star who won the Heisman that year, stated that “Randy had superior talent and I was surprised Randy didn’t get the Heisman.”
