Are Dog Rescue Adoption Contracts Turning Into Leases?

In my ongoing research on dog rescue groups, I have discovered an alarming change that some groups are making in their adoption contracts. A new article is being added to the contract that effectively gives the rescue group the “right” to Get back the dog you adopted to anytime in the future.

A rescue group from a puppy mill near my home added the following item to their adoption contract during the summer of 2011:

I agree that a representative of (name of rescue group) may periodically wish to see the dog, my residence and the living conditions that I provide for the dog, and further agree to hand over the dog to a representative of (name of rescue group ) if for any reason you consider the conditions that I provide for the dog inappropriate.

This clause is ridiculous for several reasons:

(1) The rescue team insisted on a home visit to inspect his residence. prior to you were approved for adoption. You know what the living conditions are.

(2) Another article says that you must agree to “assume all risk of ownership.” You must take the risk, but they can eliminate you dog at any time. Apparently “property” doesn’t mean what we think?

(3) An additional item says that you are responsible for all expenses incurred after the adoption. You have to pay for everything related to the dog you adopt, but they can still take you dog anytime in the future. Of course, they don’t reimburse you for those expenses or the adoption fee you paid. (FYI. You don’t actually pay an adoption fee. You make a DONATION. This is why they don’t have to reimburse you.)

(4) Another item says that you cannot gift the dog. For example, this would mean that if your life changes, you may not give the dog to your older child. You are not free to make decisions about the future ownership of the dog you adopt.

(5) Another item says that if the dog is lost or dies, you must notify the rescue team. I have no idea why.

(6) If they feel the need to sue you to enforce the contract, you must pay all legal costs, including theirs. This means that if you try to keep “your” dog, they can sue you and you will be forced to pay their legal fees and yours.

(7) We are not so restrictive about adopting children.

Therefore, while you agree to take all risks, pay all necessary costs, and have no say in the future ownership of the dog you adopt, you do not actually OWN the dog. If they can come to your house at any time to claim the dog you think you have adopted, you are obviously not the owner. You leased it.

My reaction to seeing this article for the first time was “Why would anyone agree to sign this contract?” Of course, there are several reasons why people sign these contracts.

Tea first reason That’s the same reason people often get in trouble with contracts – they don’t actually read it. However, if they read the contract, they really don’t understand the ramifications. The ransom can simply represent the contract as a standard adoption contract which many people think means they don’t need to read it. This is NEVER true. Always READ the contract thoroughly and make sure you understand and can live with each item.

TO second reason for signing these contracts is not believing that the rescue group would really come to take you dog. I recently read about a situation related to the rescue of the couple from this group. A woman’s living arrangements changed. She moved into an apartment. Someone reported this to the rescue. The group felt that an apartment was bad for the dog they had adopted, so they complained its dog. HAPPENS! Note that once they have recovered a dog, the rescue is free to re-adopt (sell) it. Be careful and don’t assume anything!

TO third reason is that people do not anticipate a situation in which the rescue team feels the need to retrieve the dog. This attitude is very shortsighted. Divorcing, moving, having a baby, having adult children or coming home, losing your job, or developing a prolonged illness are just a few of the situations that may cause the rescue to reconsider your adoption.

TO fourth reason For people to sign these contracts is to avoid disappointing the family. If you don’t read the contract before looking at any animal, you may find yourself in the situation of having children who have fallen in love with a dog, are excited to bring the dog home, and have even given it a name. Not signing the contract means turning to your family and saying “it doesn’t matter.”

Some people sign these contracts because they believe the contracts are not legally defensible. The truth of this point of view varies by region; but I doubt anyone would want to pay double legal fees to find out. Some people have an “on my corpse” attitude about someone taking their dog away, but then again, it may not be worth trying.

What everyone needs to understand is that virtually all rescue groups have their app to adopt and the adoption contract available to read online. ALWAYS read these before looking at any animals. If you are attending an adoption event, go to the information table and ask to read these articles BEFORE you look at the animals. If you find this or a similar “lease” clause, proceed with a different redemption. NEVER ASSUME that the rescue will not claim “your” dog or seek legal means to do so.

If you find this clause AFTER you have found your perfect pet, it is worth trying to get the ransom compromised by adding a time limit to this clause. I believe that most human adoptions are final after one year. All dog adoptions should be FINAL at some point. You should never be afraid that your beloved canine family member will be recovered. All members of your human family will adapt to any change. Your dog too!

So when selling to determine value, you would ask yourself “did you attach it to make it permanent?” The exceptions to this rule are the garage door opener and the door key, these are not considered accessories.

Commercial fixtures are those installed by, say, a commercial tenant or may be owned by the commercial tenant.

Everything light is not always right. Even today in 2010, some black women are still in that color bias deal. I have three words for you, “Get over it.” Black women are beautiful no matter what shade of brown we are. If you’ve been blessed with sun-tanned chocolate skin, love it and take good care of it. Not many other cultures in the world have individuals as beautiful and unique as you. And if you have a lighter finish, love yourself too, but don’t belittle or ridicule our darker brothers and sisters.

First of all, there really is no such thing as acting or sounding white. Of course, most African-Americans use it as a way to describe someone who speaks clear English, but not all Caucasians speak correctly, as some people in other cultures adopt certain dialects. There is nothing wrong with being a refined version of yourself, but some people feel the need to change character when they enter the world of work. Who can continue to act for more than 8 hours a day? Just be yourself.

7. Having a baby will keep you close.

If a man doesn’t love you, he doesn’t love you. It’s as simple as that. Having a baby with a man who is irresponsible will only make him run further, and if he has any shred of decency, he will be close to the boy, not you. Grow up.

8. It is okay to be abused (verbally / physically) as long as you have a man.

I wouldn’t keep a snapping turtle for long if it bit me too many times, so why would a woman allow a man to physically / verbally hit her just to say she has someone in her life? I know it’s been said before, but let me say it again, it’s better to be alone than with someone who doesn’t love you the way you deserve. Love yourself enough to go and fast.

9. Education doesn’t matter as long as you look like a video girl.

Sad that I even had to put this on the list, but while watching BET (Yes, I should have known better) I heard something that annoyed me. I heard a rapper admit that to her fans she believed that it didn’t matter what she said as long as it looked good. And she was fine with it. What? I hope the girls have not heard or believed that ridiculous statement. It’s wonderful to want to be physically attractive, but if you’re an airhead, none of that matters. Sure, you can get a modeling job if you’re beautiful, but you also need to know how to navigate the industry and once you’ve passed a certain age, it’s all over for you. So what? Our young women need positive role models who care as much about presenting themselves as well as feeding their brains. It is possible to do both.

After 6 years of schooling, Omari went to Naryab Madrassa in Kohat, Pakistan for religious training. He continued his studies at Kahi Madrassa. In the late 1980s, Omari fought alongside the Mujahideen against the Soviets. After the withdrawal of the Soviets, Omari continued his studies in Pakistan at the Zargary and Kohat Madrasahs in Kohat. Around 1992, Omari and her family returned to Afghanistan.

1992-1994 Omari served as a policeman in Khwost, but quit his job to farm on the family farm. When the Taliban took control in 1996, Omari began working for them. Omari claims that his tribe pushed him to take the job to avoid being labeled “the opposition.” His position was Chief of Security in Qalat.

After a year in that position, he returned to his farm for three years. In 2000, he returned to seek employment with the Taliban as a radio operator. After a year, he went to the border patrol. His focus was on controlling smuggling. In 2002 he left again and started selling used cars. In the spring of the same year, Omari began working with the CIA.

On September 14, 2002, Omari was arrested at the old Khowst airport. Omari claims that he was lured there by a messenger who told him that the CIA contact wanted to meet with him.

He was transferred to Guantanamo Bay, Cuba, on October 28, 2002. The United States hoped to obtain information on border patrol procedures, Taliban communication equipment and procedures, and biographical data on Taliban members. Between October 2002 and January 2008, Omari had 37 reports of disciplinary infractions, including participation in mass riots, threats, attempted suicide and possession of drugs. In March 2007, he was cited for throwing a cup of feces in the guard’s face.

Despite the fact that his General Staff and the Intelligence Community advised against the agreement, on May 31, 2014, President Obama exchanged Omari, along with four other Taliban detainees, for an American prisoner of war, Bowe Bergdahl. The Emir of Qatar has been recognized for his efforts to secure this agreement between the United States and the Taliban. Omari, along with the other four, will be under Qatari control for at least a year, with a ban on leaving the country. Many in the United States fear that while in Qatar, these terrorists will assist the extremists by providing strategic planning and will return to field operations after their one-year detention.

Captured terrorists have been repeatedly shown to have a high recidivism rate when released. Therefore, logic would dictate that these five top Taliban leaders will return to their terrorism. The difference is that they have had a long time to learn about America from prison and a long time to conspire. Only time will tell how much we will pay for this decision.

The plain truth about error and omission insurance in the world of independent film distribution

Error and omission insurance (E&O insurance) is something that every movie producer needs if they want to sign a movie distribution contract.

I am not an entertainment attorney or insurance salesperson, but errors and omissions insurance protects you and the movie distributor you contract with from different common lawsuits in the entertainment business.

These include allegations of breach of contract, copyright infringement, defamation or degradation of products (showing trademarks on camera), invasion of privacy, infringement of the title, catchphrase, and many other nasty legal saves.

It is an insurance policy that protects the butt of a film producer and distributor in the course of their business in the entertainment industry.

Errors and omissions insurance doesn’t address the creative side of making movies, which is why some independent movie producers often don’t plan for it in their movie budgets.

But if you want to sell your show to a movie distributor, you will have to learn what it is about at some point.

That is unless your movie distribution plan is to use your own blog to sell digital downloads or DVDs online or hit the streets with copies in the trunk of your hybrid vehicle.

I know of more than a few independent filmmakers who make decent money selling movies that way without having to worry about the cost of error and omission insurance.

I respect your energy and push to go out and sell your movies directly online or in person through all kinds of ways. That’s a post on self-distribution left for another day.

The Catch-22 with error and omission insurance has to do with dealing with film distributors.

Every distribution deal that co-producer Tim “Timbo” Beachum and I have been involved in, from independent film sales to reality shows, has involved E&O Insurance.

Once the movie is done, you probably want to get a meaningful distribution for it.

That means working with a film distributor to be launched by the main outlets nationally and internationally in every possible medium.

Film distribution deals for independent cinema usually happen in two ways. A film is screened at different film festivals, receives the attention of the distributor, and a distribution agreement for the film is offered to acquire the rights or an offer is made to buy the rights to the film directly.

Or you skip the film festival circuit and connect with film distributors directly with a reviewer and other marketing materials, such as artwork, etc. If they like what they see, a distribution agreement is sent to them for their consideration.

By then, the euphoria of making a movie has faded. Now you are dealing with the business of making movies. You have film investors that you have to pay back with interest.

Even if it was your own hard-earned money invested to produce your movie, you’ll want to be able to pay yourself back with interest.

All independent filmmakers make films for different backgrounds, financial, personal motivations, and creative needs. None of the reasons you make movies really matters to a distributor.

When it comes to movie distribution deals, it’s all about business. So once your movie sales representative, entertainment attorney, or you represent your own movie to reach an agreement and you sign a movie distribution agreement, you will immediately receive a list of movie deliverables.

The movie deliverables list can strike a filmmaker off guard. Once again, the movie deliverable list is a matter for another post.

In this movie making post, we focus on error and omission insurance, which is one of the key deliverables that a movie distributor requires you to meet immediately.

Like in a Hitchcock movie I mentioned Catch-22 with safe for errors and omissions in post, now it should be used.

It is always much cheaper to buy your own errors and omissions insurance from a reputable company than to rely on a movie distributor to cover the cost.

The problem is that some, not all, but some film distributors that deal with releasing independently produced films use E&O Insurance to take out the eyes of independent filmmakers at an inflated cost.

The film distributor will tell an independent filmmaker who is not sure of errors and omissions not to worry. They will set up a policy with an insurance broker they know, pay for it, and only deduct the cost from any future advances or royalties on the film.

Sounds good if you don’t have the money to buy an E&O insurance policy, considering there is no money coming out of your pocket up front. But it doesn’t feel right when you have your advance down payment or subsequent royalty payments are affected by E&O insurance.

You can end up paying between 200% and 400% of the cost. Like I said, not all independent movie distributors do this kind of nonsense, but there are some who do.

All businesses have people who want to screw you. Dealing directly with an agent to purchase your own errors and omissions insurance policy WILL ALWAYS SAVE YOU MONEY.

But I fully understand how you are going to finally finish a movie and finish without having a hundred dollars in your budget to deal with the real costs of getting the movie deliverables.

It’s a smart move in pre-production to contact companies that specialize in producer’s error and omission insurance to compare quotes. Once you have those prices, you can include them in your budget.

I like to include it as part of the post-production budget as an order line. It helps remind me, as an independent film producer working on a budget, that after finishing a film, there is still a long way to go to complete post-production and film deliverables.

Even if you know you won’t have the money for E&O insurance after you sign a movie distribution contract, at least knowing the cost of the policies, you can negotiate the cost the distributor will charge you.

This is the part I call Catch-44. Be careful when dealing with movie distributors who will not accept your error and omission insurance policy.

They may have special requirements, such as that your policy is not from a licensed operator in your state or some other reason for rejecting your E&O insurance.

If you’ve already signed an agreement with them before asking if your own errors and omissions insurance policy meets your requirements, you could be in a little bit of a fight.

You have followed the rules and saved money by purchasing your own E&O insurance policy, but now you are bumping into this issue. If you haven’t signed a deal, move on to another dealer.

As long as your E&O insurance policy is from a reputable company, another movie distributor will honor it if they want your movie.

If it’s signed on the dotted line, you may have to put up with it, bite the bullet, and go with a broker recommended by the movie distributor who will generally charge a little more than what you would have paid on your own.

The insurance company does not add the margin. It’s the movie distributor adding his juice to do you a favor by covering the cost.

The truth about error and omission insurance in the world of independent film distribution isn’t always fair or pretty, but neither is life.
