Originally used as basic transportation for home and business, the automobile has become so much more since the days of Ford’s Model T. Today it supports important industry, as well as wonderful comfort and a better standard of living for many. But the negative aspects of this great invention now become more evident.

Consider the mess cars are making of our beautiful natural world as they spread smoke and noise into a once serene environment. And in their production and use, cars consume Mother Nature’s resources at an ever-increasing rate.

As in other industries, the car companies’ drive for higher profits has changed the way cars are produced, marketed, and sold to consumers. The product manufacturers most want to sell is not your basic transportation needs, and advertising departments are working feverishly to influence your choices. They’ve done a good job of marketing over the last few decades, with new owners proudly parking impressive, shiny new cars in their driveways, just like TV commercials.

Cars are aggressively marketed for maximum sales and corporate profits, as in other areas of marketing. As long as companies need to increase their results, their efforts to sell products, good and sometimes bad, will be exhausting in the presence of strong competition.

This larger, more expensive car sales strategy is not new. In a dealer showroom back in the 1950s, I had my mind set on a certain economic model, but was continually pushed away from it. In fact, the seller refused to sell me the smaller model and I left. 35 years later and in a showroom helping my daughter with her concerns about options and costs, the salesperson turned to me and asked; “Who is going to buy this car, you or her?” While on our way to another dealer, I mentioned that he must be having some personal problems, maybe at home, maybe with his sales manager.

The automobile industry is a prime example of how astute marketing can sell maximum corporate profits. Consider car commercials on television; they are not seriously trying to sell small, simple cars that consume the least amount of resources. Most are for bigger, flashier styles, and with added features your friends will envy. Hybrid or electric cars may take the lead in the coming years, but they will be manufactured at a high price and sold for maximum profit. Most by far will not be modest in design.

Along with continually remodeled styles, newer products can include frivolous gadgets and features that seem like good selling points if marketed correctly. And there has been a strategy where the size of a model grows year after year until it is time to buy again; then your favorite model has grown in size, features and cost, and you have to gamble much higher than expected. Because what will your neighbors think if the option is to downsize to a more practical purchase like the one you want to trade?

Because commercials are among the loudest on television and can interfere with family conversation if not muted. But the annoying invasive clamor draws attention and results; that’s how much advertising works. Rude and direct works for them. Targeting the young and the young at heart, commercials often sensationalize performance that showcases high-speed maneuvers on city streets and highways. They are sending the wrong message considering the lives lost from driving at excessive speeds. This is insensitive and hurtful, but it sells products. One has to wonder where the conscience of the corporate manager hides; Perhaps ethics is a detriment to advancement to senior management positions in some companies.

The overall result of many years of this massive marketing effort is that cars are now commonly bought for their superficial condition, although they can be too expensive when they are excessive for the owner’s budget or needs.

It’s unfortunate that in the wealthier areas of the world consumers are so enamored with these sleek, roomy, environmentally unfriendly ‘Look at Me’ cars. But that’s what we’ve been told to buy, most days of the year; and we are like sheep when we are herded into industry showrooms.

We are being taken for a ride.

Marketing and branding are at work continuously, as is the ongoing drive to consume more steel, plastic, oil and gas. But why would the industry promote a staple product that represents modest, supportive and friendly lifestyles when it would shrink business?

On television during an earlier oil shock, a smiling Automobile Association spokesman defended why they aren’t marketing smaller cars. “People couldn’t just sell their cars and buy smaller ones.” The TV commercial that immediately followed the news bulletin was for a flashy full-size SUV. Fun and funny.

More friendly vehicles are coming off the drawing board as public interest in the environment increases. Can consumers resist the persuasions toward pizzazz and added extras that might lead to workplace parking? Can we practically expect them to switch to economy cars? Of course, there is a case for greater comfort for longer trips, but where is the practical limit?

Let’s face it, this inefficient, expensive and unnatural way of getting around needs to be changed. It may be necessary to have a car to get to work, school, and shopping; This is how planning has designed our urban layouts, but that has turned out to be a big mistake.

Even if we’re inclined to use public transportation, it’s probably not there or impractical to use if the government has had other interests. And if it’s available and convenient, it’s still probably not what most would consider; everyone else is driving and Peter has a new Super Spitter XYZ!

The public’s desire to improve the way we live and treat the environment will change, but it won’t be easy if we continually face massive persuasions to consume more. This necessary means of transport needs a review of its design, marketing and effects on society. The average person doesn’t need luxury on wheels when they spend only a few hours a week in the car. The car also does not require high speed and polluting power to drive within the speed limit. A fuel-efficient car description should include: The smallest vehicle that meets your transportation needs in reasonable comfort.

The car should take a less destructive and healthier place in our society, but can it happen? When the auto industry hit a brick wall during the financial crisis, the rescued industry reorganized, redesigned, and modified to some degree for energy efficiency. Then came the familiar dazzling ‘Show Me Off’ commercials. There is little advertising of small and simple transport, so they can then proclaim that people did not want to buy them.

Why not check out your car’s requirements to see if you can make a few changes to a more basic, stripped-down selection? And consider a reduction in usage. If public transportation is available, give it a try. I have been positively surprised by how comfortable and relaxing traveling by public transport can be. The ride is free time and there are no expensive parking requirements when you arrive.

Businesses must continue to make money and thus may face a brick wall unless politicians make a serious and timely effort to address these issues for society and nature.

Instagram: 6 reasons why you do my day to day

Instagram is at the top of the daily enjoyment list for me. When I started using Instagram, I was looking for inspiration and motivation for the kitchen. 99.9% of my photos are of food that I have created. The reason for this is to show that preparing delicious and healthy meals does not require a chef trained by the Culinary Institute of America, nor many fancy ingredients. I like my meals to be simple and tasty, hence the hashtags #KeepItSimple and #KeepItTasty. There’s no reason to cloud the flavor of your food ingredients with items that don’t enhance the flavor of the dish or serve a purpose.

Along the way, Instagram took on a different role in my daily life. The inspiration and motivation were still there, but the unintentional comedy was elevated to new levels. Before I discuss the images that are my favourites, let me say that I love to laugh and these images help take the stress out of life, even if just for a few moments. If you’re on Instagram, I think you can agree with these photos that they make you laugh when you scroll through the images on your iPhone or iPad.

We have all seen these photos. The one where the barista, do they just call them that at Starbucks, decides he’s either bored or he’s a starving artist and turns your cappuccino into a canvas. You see heart shapes all the time, but I’ve never seen a face or an animal. These images always make me laugh because I can imagine the person ordering the cappuccino from him in hopes of trying that steamed milk and hot coffee and relieving their stress and the results of a heart. Who decides the barista who gets the heart? Why does the person on Instagram decide another image of milk in the shape of a heart should be posted? We understand. Coffee as art. Let’s go!

Quest Bar Pictures

I’m not sure when the Quest Bar became the face of healthy eating, but if you visit a healthy feed, there’s almost certainly a picture of a Quest Bar. And it’s not enough to just be a Quest Bar, this product has been minced and put into cookies and cakes, crushed and thrown into yogurt and so many other variations of its use that this post would be too long. I’ve never had a Quest Bar and most likely never will, so I can’t comment on the taste. Why do Instagram photos make me laugh? They are everywhere and you can’t go a day without seeing a photo of them.


I mentioned coffee barista artist photos above, but you can’t go a day without photos of Starbucks cups. They can be just the outside of the cup, they can be the inside of the cup. I’ve even seen photos of the interior of the Starbucks. I look at them and think: you bought a coffee from Starbucks and somewhere between paying and drinking you decided you needed to photograph it, but did you try it first? Did you sit down to talk with your friends and stop the conversation to take the photo? I have so many thoughts floating around in my head and I laugh because I’m putting together a conversation that most likely isn’t happening, but in my mind it is and it’s hilarious.

This is my third favorite photo on Instagram. I’m not sure why it makes me laugh when I see them, but they do. I guess inside I’m thinking: when you can’t bake, microwave. Maybe you secretly want to make a mug cake. I’m not sure, but I’m sure when the photos appear on Instagram, I laugh my guts out. I can say that I have seen some wonderful mug cake creations like the molten chocolate mug cake. That’s unbelievable in my mind, but the old man I poured 1 egg, protein powder and whatever else and voila, ‘baked’ a protein cup cake just made me laugh out loud.

Green Smoothies

These just kill me. They’re on Instagram en masse and they make me laugh because my thought is: Wow, you know how to use your blender. It’s a culinary sarcasm, of course, but how many pictures of green smoothies can a person see before thinking: great, now try cooking those greens in a different way or way? I know smoothies are quick and I make them too, but when I make them I don’t share them on Instagram because I didn’t do anything but add water, veggies, and fruit to my blender. I want my Instagram feed to be inspiring and motivating to get people into the kitchen to cook, but with that said, if a green smoothie gets someone started on the path to health, then I’m all for it. Let me be clear and say that there is absolutely nothing wrong with green smoothies or smoothies in general, it’s just that when you see 20-50 pictures of green smoothies a day, you have to laugh.

Seflies before, during or after workouts

These are my all time favourites. The flexed pose photo is the best, but today I’m introducing my friend Marlene from Mission To A (other) Marathon because her selfies almost had me hyperventilating. She loves it when she posts pictures of herself from her office bathroom after a sweaty walk or run and her face tells the whole story. My favorite picture of Marlene is with her goggles on, as she looks like those guys in Despicable Me and therefore my nickname for her is Despicable Marlene. Selfies are the gift she keeps on giving because you know you’ll see dozens of them at any given time and one is more fun than the other. Do you wait until the bathroom is clear to take the photo? Don’t you mind if the bathroom is crowded?

These 6 reasons are why Instagram will always have a place in my daily routine. How you can’t laugh at some of the things you see on Instagram is beyond me. There’s a lot of inspiration and motivation, like the 21-day sugar detox I’ll be posting about on Monday, but some of it is also funny. I really enjoy following people on my feed to come up with creative ideas for cooking, going to the gym, and making me laugh.

Benefits of the gym at home

You know that old saying: “There is no place like home.” It’s a cliché, but for some people, there’s no place like it to get a good workout with the help of a home gym.

Let’s face it, some of us prefer not to go to the club and prefer to exercise at home. Maybe we don’t want to train with strangers. We may feel uncomfortable taking a shower in a public place. Maybe we don’t want to leave our belongings unattended. Or we don’t want to drive or take public transportation to get to a gym.

When we exercise from home, not only do we not have to worry about all of the above, but we also do not have to pay public transportation, parking or gas fees.

With a home gym set up in a spare room, we have control over our surroundings. Psychologically we feel more comfortable in our own homes and that could mean we can focus on having better workouts.

For those of us who are really busy, being home may be the only time we’ll find to exercise. Having a gym at home is practical when we don’t have free time for anything but we know that keeping fit is important.

Indian Labor Laws – Part 2 – Employee Termination for Misconduct

This is my second article in the series on employment and termination of employees by Indian corporations. My previous article addressed the question of whether an IT-enabled and software development company qualifies as an ‘industrial establishment’ within the meaning of the Industrial Disputes Act 1957 (“IDA”) and whether such a company can follow the ‘contract and fire policy for termination of necessary services for reasons other than employee misconduct without compliance with the IDA. This article deals with a situation where termination of services is necessary due to an employee’s misconduct and compliance with procedures required by Indian labor laws.

For clarity let us take a hypothetical situation where the services of an employee say Mr. Shyam Nagpal has been terminated by an IT company with immediate effect for misconduct and the Company now wants to understand the legal consequences of such termination.

Mr. Nagpal was engaged in software development and officiated as “Group Leader”. As a group leader, Mr. Nagpal was responsible for supervising and regulating the work of two or three associates in his team, in addition to providing software development services. Mr. Nagpal’s performance during the first year of service was above average, but his performance deteriorated thereafter and he was frequently late for work. Considering Mr. Nagpal’s lackluster performance and due to the company’s decision to reduce its workforce, Mr. Nagpal’s services were terminated effective immediately with one month’s salary in place. The Company soon realized that it had not taken adequate steps to terminate Mr. Nagpal’s services and is evaluating his involvement and exposure under the law.


The validity of Mr. Nagpal’s dismissal and the consequences thereof under Indian law would largely be determined by the crucial question of whether Mr. Nagpal was a ‘worker’ within the definition of IDA.

An employee is called a worker if he or she is employed to perform any manual, unskilled, skilled, technical, operational, clerical, or supervisory work for hire or pay. A person who is primarily employed in a managerial or administrative capacity, or who is employed in a supervisory capacity receives wages in excess of Rs 1,600/- per month or performs duties primarily of a managerial nature is excluded from the definition of a worker. Supervisor means a person who has the authority, in the interest of the employer, to hire, transfer, suspend, fire, remove, promote, lay off, assign, reward or discipline other employees or the responsibility to direct them or resolve their complaints or recommend such action and in the exercise of such authority uses independent judgment. Simply put, a supervisor is someone who has authority over others, to supervise and direct.

The Labor Courts and Civil Courts of India have considered the actual and predominant functions performed by an employee and the remuneration received by such employee as the basis for determining classification as “worker” or “non-worker” and have held that mere managerial or administrative designations are not conclusive of any employee’s status as “non-worker.”

The Supreme Court of India has repeatedly held that it is the main functions performed by an employee that must be taken into account for the purposes of determining the actual status of the employee, i.e. whether the employee has been performing administrative work, management or supervision. . An employee may occasionally be required to perform managerial, supervisory, or administrative work, but such occasional performance by itself does not determine the actual status of the employee and it is the primary or most important duty performed by the employee that determines the actual status of the employee and whether or not the employee in question is an IDA worker.

Accordingly, whether Mr. Nagpal, who was presumably not in a managerial or administrative role, was employed in a supervisory capacity as a Group Leader or for software development/technical work, would depend on whether the principal and principal functions performed by he were:

(a) those of a supervisory nature, that is, had powers to give instructions to others on the actual manner in which they should perform and carry out their duties and examine the work done by others to ensure that it was being done correctly, or
(b) of a nature carried out by a software developer.

If Mr. Nagpal did primarily supervisory work, but incidentally or for a fraction of the time, also did some software development work, then he was employed in a supervisory capacity and would not be an IDA worker. Conversely, if the primary work performed was software development, the mere fact that some supervisory functions were also performed incidentally or as a small fraction of the work performed by Mr. Nagpal will not convert his employment as a skilled worker. in one of supervision. ability.

Considering that the nature of the work performed by Mr. Nagpal was primarily software development and not supervisory, Mr. Nagpal would be classified as a “worker” in terms of IDA.

In terms of the IDA, an employee in the worker category who has been in continuous service for at least one year cannot be dismissed at the will of the employer unless the employee is dismissed through disciplinary means or as a consequence of non-renewal of the employment contract. worked. employment, or terminated for continued ill health, etc. Termination for any other reason, including termination of service for reduced turnover, is equivalent to dismissal and the IDA prescribes a detailed procedure for the dismissal of a worker, including compliance with the last-come-first-served rule. leave, notice, payment of prescribed compensation, i.e. 15 days of average wages for each full year of continuous service, prior government filings/approvals, if required, etc.

For termination of service for disciplinary reasons, the procedure for dismissal of an employee (who is classified as a “worker” under IDA) for misconduct and/or indiscipline (which should normally be incorporated into a company’s Employee Handbook) would need to be in terms of broad principles of natural justice, the IDA and the guidelines evolved from various court decisions as follows:

(i) issue a charge sheet;
(ii) conduct an internal investigation;
(iii) carefully read the investigation officer’s report;
