An established new concept or realized invention potentially has future economic and commercial value. However, the potential financial returns of the invention may not be immediately realized by the concept developer (ie, the inventor). Due to the conversion of an abstract invention into a marketed product or service, it is important for an inventor to ensure that the ideas and rights related to the invention are protected for a defined period of time.

Article I, Section 8 of the United States Constitution provides that, to further the progress of science, inventors have “exclusive” rights to their respective discoveries. The US Patent and Trademark Office (“USPTO”) is the government entity responsible for issuing patents in the United States.

A design patent protects various visual features of an article of manufacture and covers newly invented ornamental design. It protects the appearance of the invention and is comparatively cheaper and quicker to patent. A design patent does not directly protect the functional characteristics of an invention. Therefore, competitors can sometimes get away with changing the general appearance of a patent-protected product. By contrast, a utility patent protects the functional aspects of an invention. A single utility patent can protect many different variations of products, thus becoming cheaper in the long run.

However, a situation may arise where the invention has a unique function or structure associated with a unique ornamental design. In such a situation, adequate protection could be provided by a combination of design and utility patents. After due consultation with a patent attorney, applications for both patents and utility designs can be filed.

A design patent application mainly includes a specification and drawings incorporating the figures. The specification includes the preamble, figure descriptions, and sole claim. The drawings contain the essence of what the design patent protects. Therefore, drawings must be carefully drafted in accordance with the USPTO’s Manual of Patent Examination Procedures (“MPEP”). In addition, the drawings must indicate the features that the patent is intended to protect, which makes drawings derived from 3D models (using software such as Pro-Engineer, Solid Works, and CATIA) often useful.

A utility patent application, on the other hand, will include an abstract, the background of the invention, a summary of the invention, drawings, brief descriptions thereof, a detailed description of the preferred embodiment(s) ) of the invention and multiple claims.

Although there are conceptual differences between design patents and utility patents, the substantive processing of design and utility patent applications is similar, and both types of applications will face a novelty and obviousness test at the USPTO. This makes obtaining an opinion of patentability or infringement prior to filing very careful.

Infringement of a design or utility patent occurs when the exclusive rights granted to the owner of the patent are violated. Infringement of a design patent generally depends on whether the accused design and the patented designs are substantially the same. Infringement of a utility patent typically depends on whether the patent claims literally “read on” the charged invention or whether the differences between the charged and patented products are insubstantial.

Whether an invention is patentable and whether it is infringing are separate but related issues. An invention that conflicts with an enforceable patent will not be patentable, although an invention may not be patentable and not at risk of infringing another patent (for example, all the patents it covers might have expired). In the event that an inventor realizes that his product is probably not patentable, it may be wise to have an infringement opinion issued to make sure there are no patent trolls waiting on him.

One of our clients wanted us to create a website for his vintage collectible card business. They are live “rips” of old, unopened sports cards (working with this type of business was a first for us)!

The challenge was to make their website, which features a wide variety of sports cards from several decades, easy to navigate.

My advice to you: think hard about how you organize your home page. If visitors land on a cluttered and confusing page, their first impression will be overwhelming and they will be directed to one of your competitors.

If you don’t have a brand guide, it’s time to create one to identify your style and guide team members.

How to Own an Irish Wolfhound

One is not so much “owning” an Irish Wolfhound as being “owned by” an Irish Wolfhound. I am currently “owned” by two, and wouldn’t have it any other way. They are typical of their breed and are an endless source of fun and joy. Once you have been “owned” by a Wolfhound, you have been touched by a special magic and you will never be the same again. But be careful! They are addictive! You can’t stop at one!

I am an owner, not a breeder. The thought crossed my mind, but I had to be honest. He would be a lousy breeder. I could never give away any of my “puppy grandchildren”! Not for any amount of money!

Years ago, when my husband and I first saw “Chewbacca” (the “Wookie” who traveled the universe with a young Harrison Ford in Star Wars), we looked at each other and said, “I want one of those!” Unfortunately, the Wookiee was a mythical creature and, as far as we know, no one was breeding them here on earth.

Then one day we came across a photo of an Irish Wolfhound, standing with his face to the wind. The resemblance was uncanny. “There’s our Wookie!” We cried simultaneously and, without any preparation, quickly decided to adopt one. Ah, those were our innocent days!

Irish Wolfhounds are noble animals; gentle giants, whose basic nature is that of your typical “couch”. They love their comfort as much as you do. They are perfect “babysitters” for your children and have the patience of a saint. However, having such a large dog comes with many responsibilities, as well as immense pleasures, as we would soon discover.

First there was the added expense of having to trade in our beloved Mercedes for a full-size four-wheel drive pickup to accommodate the dogs. Then came the repair of the sofa, although since there is no room for us on the sofa, I just cover the broken areas with a blanket and hope for the best. The fencing had to be reinforced, and I have lost count of the number of times my husband replaced the flywire on our screen doors. Our once soft suburban lawn (well, it used to be a lawn, not sure what you’d call it now), looks decidedly rustic. It actually looks like a horse paddock. As for my carpet and walls, well, let’s not get into that, but please don’t be offended if I never invite you over to my house.

I love my gentle giants, and who cares if they almost ruin the garden, the carpet, the walls, the sofa and almost bankrupt us with the food and vet bills; I couldn’t imagine life without them. They have many wonderful qualities that allow me to feel this way. They share all aspects of our lives and love nothing more than helping “mother” in the home office and “father” in the garden. In fact, our two Irish Wolfhounds have been very industrious this summer, helping Dad with the garden renovations. I think they are trying to build a pool on the side of the house. They must bother them so much when the father keeps filling it up again. They also play very well with our daughter. In particular, they like to sneak into her room at night and select a toy to play outside with. They never destroy toys. I always find them in perfect condition, if a bit damp and gross from experience.

Our initiation into Wolfhound parenting began with the adoption of Wookie, a gray male. (What else did you expect us to call it?) Our daughter was about two years old, so we felt like we had two babies to care for. Wookie was a real clown, and to describe him as clumsy would be putting it mildly. When Wookie was just six months old, we realized that sharing our little house with him was going to be a challenge. Wookiee’s tail could clear a table with a snap, and leaving food on the kitchen table invited trouble. Unlike other dogs, who can only smell delicious leftovers in the sink and dream about them, Wolfhounds can see them and reach for them.

Shortly after Wookie’s arrival, we find ourselves adopting a “rescue” dog. (Sadly, some people don’t research the requirements for owning one of this breed, only to realize later that they should have bought the Miniature Poodle.) Standing approximately 35 inches (90 cm) tall at the shoulder and weighing 78 kilos, she was, and is, a sight to behold. We assumed her age to be around three and decided to celebrate her “her birthday” with chocolate cake every St. Patrick’s Day. Wookie took a liking to her immediately, and although Guinny, as we decided to call her, sometimes found him a bit of a problem, she developed a fondness for him and the two became good friends.

Guinny, we discover, loves a good cup of coffee. Not the simple black things. She likes hers white with two sugars, and no, of course we don’t give our dog coffee! We don’t need to. She helps herself. I always know she’s been in my coffee from the telltale spills around the cup, or if I miss that (sometimes it’s wiped off to hide the evidence), I know she’s been there from the weird taste left in the cup.

Irish Wolfhounds are warm and affectionate with sensitive and gentle natures. I don’t know if I would recommend them as guard dogs, although owners can be sure that if attacked, their Wolfhounds will fight back to the death. The sheer size of these animals, combined with their deep, impressive barks, is probably enough to scare off most would-be burglars, but I don’t know if that would work in my house. I can only see it now. There they would be, standing by the fence, each with their own favorite toy held firmly in their powerful jaws. My two fearless defenders of hearth and home… “Don’t come in here or my bear will catch you!”

Owning an Irish Wolfhound is an honor. Being accepted and loved by one in return is truly a gift from God. My own furry children are an endless source of fun and companionship, and I haven’t even begun to scratch the surface of my experience. (Speaking of scratching…is that a flea?)

350 cc implants – How big will my breasts be?

One important thing to understand about this question is that 350cc breast implants can increase one woman’s breast size very differently than another. Since every woman’s body is unique, of course, breast implants, once placed, may have a different effect on you than some breast augmentation photo you may have found on the Internet. For the first point of your current bra cup size, you can estimate a 350cc breast implant to increase your breast size by about 2 cups. As a very general rule of thumb, it is often considered that for every 175cc to 200cc of implant volume, a woman could experience approximately one bra cup size larger. So the 350 would fall in the low range of increasing her breast size by about two cups. If you currently wear an AA cup bra today, growing two cup sizes would be in the range of a C cup, for example.

Profile: Low, Moderate, High

The second factor mentioned of the profile of the implant is important, especially in regards to the width of your breasts. If you have a smaller bra band size, like 32 to 34 inches for example, a higher profile implant is usually used to achieve a C cup bra size. In general, the higher the profile, the smaller the width of the implant. For women with a bra band size of 36 to 38 inches, a lower profile is generally recommended.

Placement above or below

The final factor mentioned above relates to the placement of the implants. Most women choose to place the implant under the muscle. In this case, a slightly larger implant is needed to achieve the same result as an implant placed on the muscle. Many doctors suggest that the difference between the two locations can be as much as 15 to 20 percent. In other words, a 350cc implant under the muscle will likely be similar to a 300cc over the muscle due to the compression of the implant under the muscle.

Use of meters

A good way to estimate how your own body will be affected by implants is to use an implant sizing system. New systems available today allow you to try a wide variety of cup sizes before making your final decision.

In this case you may want to try a range of gauges from 300cc to 400cc in 50cc increments. Implant sizers, also known as trial implants, are designed to be worn outside the body but inside a bra. Similar in volume to a breast implant, the sizer will give you a good idea of ​​how these sizes will increase your bra size.
